What is a plea bargain? A plea bargain is a negotiated agreement between the defense and the prosecution in a criminal case. Usually, the defendant agrees to get a lower sentence, while the prosecution gets to have a guilty plea without having to go to trial. If you watch “Law and Order,” you’ll see a lot of negotiations before the trial begins, between the prosecuting lawyer and the defendant’s lawyer, to try to avoid the trial.
